Inattentive drivers can cause motor vehicle accidents

When involved in a collision, many people claim that they simply did not see the victim’s vehicle — especially when the other vehicle is a motorcycle. Any number of reasons such as distracted driving can cause a driver to become inattentive and make a crucial error while driving. Sadly, a large number of motor vehicle accidents that occur here in Florida and elsewhere are blamed on inattentive drivers.

A 91-year-old woman was waiting to turn onto U.S. Highway 98 in her vehicle, which was facing north. She began turning left, but did so into the path of an eastbound motorcycle. The 41-year-old woman riding the motorcycle did not have time to avoid the collision that followed. Reports indicate that the woman initially survived the crash and was taken to an area hospital.

Tragically, her injuries were too great, and she succumbed to them at the hospital. The woman driving the car was not injured and told police that she did not see the motorcycle when she pulled into the intersection. The Florida Highway Patrol is handling the investigation. It is unclear whether any charges are being contemplated in connection with the crash.

Regardless of whether the elderly woman faces criminal charges, the family of the deceased motorcycle rider retains the right to file a wrongful death claim against her. As would be the case in other motor vehicle accidents, if the family can successfully establish that the driver was negligent, the court could consider an award of damages. Even though monetary restitution will not bring back the family’s loved one, it could help with the unexpected expenses and other damages the typically follow tragedies such as this.
