Personal injury claims possible after accident at festival

Many Florida residents enjoy going to the festivals and carnivals that are held in the state each year, and the food, rides and games are attractive to children and adults alike. It can be easy to take for granted that the food is edible, the rides are safe and the games are not rigged. A case of food poisoning or the inability to win at the games might be inconvenient, but more than likely will not be life threatening. However, if one of the rides fails, people can suffer serious injuries or even die. Those who are seriously injured might consider filing personal injury claims, seeking restitution for the damages incurred as a result.

The seriously injured victim of an accident at a festival here in the state retains the right to do just that. Witnesses reported that one of the carnival rides fell apart while riders were aboard. Five people were fortunate enough to only suffer minor injuries. At least one other person suffered serious injuries and was flown from the scene to an area hospital.

The father of two of the people who were on the ride when it failed reported that emergency personnel had to extricate some of the victims. Officials said the rides at the Florida Seafood Festival in Apalachicola were checked prior to the festival’s opening. They were checked again after the accident, but that is not stopping the state from sending in investigators to determine what happened.

The conclusion to that investigation along with an independent one might provide enough evidence to establish liability in a personal injury case. Helicopter rides, hospital care and other damages can add up quickly. The financial burdens can cause a significant amount of energy that should be focused on recovery. A successfully litigated claim in which negligence is established against one or more parties could result in a monetary judgment that could help defray the burdens the financial needs of recovery require.
