Breaking down on the interstate here in Florida — or anywhere else for that matter — used to be more of a hassle than it is today. Cell phones make it easier to get help if a driver is unable to handle the vehicle issue alone. In either case, sitting on the shoulder watching cars whiz by can be unnerving since many motor vehicle accidents occur while a vehicle is stranded on the side of the road, and the destruction caused by these crashes can be devastating to both persons and property.
This fact is illustrated by an accident that occurred on Interstate 75 on a recent Friday afternoon. An RV carrying the metal band “Adrenaline Mob” and a van with a trailer traveling with the band were pulled onto the southbound shoulder due to a flat tire on the RV. Between the two vehicles, there were nine people.
For an as yet unknown reason, a semi-truck left its lane of travel and entered the shoulder. It then crashed into the stopped RV. Flames erupted from the RV, and it took several fire companies and nearly a half hour to get the fire under control.
Fortunately, a group of registered nurses came upon the scene and helped render aid. Even so, one died and six people were taken to hospitals. The other two declined medical treatment.
While the official investigation continues, the deceased individual’s family and those who were injured may file civil actions against the truck driver and employer in a Florida civil court. Establishing through the appropriate evidence that the truck driver was negligent may result in awards of damages to the plaintiffs. Any restitution resulting from monetary judgments could help with the unforeseen expenses associated with this and other motor vehicle accidents.
