Some motor vehicle accidents are not discovered until hours later

Most Florida residents would like to believe that their passing would be noticed right away. Unfortunately, for some who die in motor vehicle accidents, the scene of their deaths is not discovered until hours after the event. This can sometimes make determining exactly what happened problematic, especially if only one vehicle was involved and all of the occupants were deceased when police arrived.

This was the case on a recent Thursday morning near mile marker 2 on Interstate 10. A motorist driving past that area noticed the wreckage and called police. By the time troopers with the Florida Highway Patrol arrived at the scene, the driver and his passenger, both of whom were from Alabama, had succumbed to their injuries.

From what investigators have pieced together so far, the driver somehow lost control of the vehicle. It went into a spin and slammed into a tree. It appears that neither of the vehicle occupants were properly restrained at the time of the crash. It is also not yet known whether their deaths occurred closer to the time of impact or closer to the time they were discovered.

As is the case in other fatal motor vehicle accidents, the surviving family members of the dead passenger may file a wrongful death claim against the estate of the driver. If a Florida court determines that negligence led to the death of the victim, it may consider an award of damages. Any restitution received from a monetary judgment could help with the inevitable financial losses that accompany an unexpected death.
